LESSON AGREEMENT

Policies & Procedures

1. LESSON PLANS

Schich Swim Academy offers two service formats:

A. LA FITNESS – MONTHLY TUITION PLAN

• Enrollment at LA Fitness Windermere operates under a monthly tuition model, not by the number of classes attended.

• Tuition secures the swimmer’s spot, time slot, and instructor for the month.

• Whether or not the swimmer attends all scheduled lessons, tuition remains due in full.

• Missed lessons do not reduce the tuition amount, transfer to another month, or qualify for a refund.

B. AT-HOME OR CONDOMINIUM LESSONS – PACKAGE PLAN

• Lessons conducted in residential or condominium pools operate as prepaid packages.

• Packages must be fully prepaid before scheduling and used within the agreed validity period.

Each class lasts 30 minutes.

2. PAYMENT POLICIES

All lessons and tuition must be prepaid by credit/debit card to confirm participation.

• Monthly tuition (LA Fitness):

  • Automatically charged on the 1st day of each month for the following month of lessons.

  • Payment secures the swimmer’s reserved spot and instructor.

  • Late payment beyond five (5) calendar days may result in immediate suspension and loss of the reserved slot.

• Lesson packages (At-home):

  • Packages must be paid in full before lessons begin.

The Company may suspend services without notice if payment is overdue.
All outstanding amounts must be paid in full before cancellation or renewal.

3. CONTRACT CANCELLATION POLICY

For monthly tuition programs (LA Fitness), lessons renew automatically on the 1st of each month.
To discontinue enrollment for the next month:

• Written notice must be submitted by the 15th of the current month.

• Cancellations received after the 15th will not stop the automatic charge for the upcoming month, as the system reserves the swimmer’s spot and instructor in advance.

• Once the automatic debit for the new month has been processed on the 1st, no refunds or reversals will be issued.

This policy ensures fairness and schedule stability for both instructors and students.

4. LA FITNESS WINDERMERE FACILITIES

Please follow facility rules:

• Locker rooms can't be used for change clothes. The change PODS is disposable at the pool.

• Showers are not permitted. Just the one in front the swimming pool.

• Restrooms are for basic needs only.
  Failure to comply may result in termination of lessons without refund.

5. REFUNDS

• Monthly tuition: Non-refundable and non-transferable, as it secures an instructor and time slot.

• Lesson packages: Early termination is subject to a 30 % cancellation fee.

• Once lessons are scheduled or begun, no refunds or credits will be issued, regardless of attendance.

• Services scheduled or delivered are considered fulfilled and billable.

6. SWIM INSTRUCTORS

Instructors are assigned based on swimmer age, skill, and location.
Schich Swim Academy may reassign instructors when necessary to ensure quality and continuity.

7. PREPAREDNESS

Swimmers must be ready at the scheduled time and wear proper swim attire.
Lessons end at the regular time even if the swimmer arrives late; missed time is not refundable or replaceable.

8. PARENTAL SUPERVISION

• Swimmers under 15 must have a parent/guardian on-site.

• Swimmers under 3 maybe require a parent in the water.
  Failure to comply may lead to lesson cancellation without refund.

9. SCHEDULING

Schedules are confirmed only after payment.
Requested times are not guaranteed until payment is processed.
For monthly tuition, the schedule represents a recurring reserved slot, not individual session bookings.

10. CANCELLATIONS AND MAKE-UPS

Schich Swim Academy maintains a separate Cancellation & Make-Up Policy which forms part of this agreement.

Key points:

• A minimum of 24 hours’ notice is required for any cancellation.

• One (1) make-up per month is allowed only with proper notice.

• Make-ups must be scheduled after the missed class, used within 30 days, and cannot be rescheduled or refunded.

• No make-ups for no-shows or cancellations without notice.

• Make-ups are a courtesy, not a right, and subject to availability.

If an instructor arrives for a confirmed class and the client cancels on-site, the lesson is counted as completed.
Medical absences are accepted only with a valid doctor’s note provided in advance or within 48 hours in emergencies.
Failure to comply may incur a 10 % penalty of the plan value.

11. LESSONS AND WEATHER CONDITIONS

Lessons may shift to indoor or dry activities if weather prevents swimming.
High temperatures or light rain are not valid reasons for cancellation.
For at-home lessons, only the instructor may decide if weather is unsafe.
If the parent cancels while the instructor deems conditions safe, the class is considered completed.

12. CANCELLATION BY SCHICH SWIM ACADEMY

The Academy may cancel lessons without refund if a swimmer exhibits unsafe or inappropriate behavior (biting, hitting, spitting, excessive crying, or leaving the pool without permission).
All remaining lessons will be forfeited.

13. POOL CONDITIONS (AT-HOME)

At-home pools must be clean, safe, and at a proper temperature.
The Academy may cancel or shorten a lesson without refund if the pool is unsanitary, unsafe, or too cold.

14. NON-SOLICITATION AGREEMENT

Clients may not solicit or hire Schich Swim Academy instructors privately.
Such conduct is a breach of contract and may result in legal action and termination of services without refund.

15. MULTIMEDIA RELEASE

I authorize Schich Swim Academy to use photos, videos, or recordings of me or my child(ren) for promotional and educational purposes.
I waive any right to compensation or claims regarding their use.

16. ASSUMPTION OF RISK

I understand that swimming involves inherent risks, including injury or death.
I confirm that I or my child(ren) are physically and emotionally fit to participate.
Schich Swim Academy does not inspect or maintain pools and is not responsible for their safety or maintenance.

17. LIABILITY RELEASE

As the legal guardian, I release and hold harmless Schich Swim Academy (Silvia Schich Sports LLC), its owners, staff, and instructors from all liability for injury, loss, or damage arising during lessons or while on premises.
Participation is voluntary, and I waive all rights to future claims.

18. ELECTRONIC SIGNATURE

By signing or checking the box, I confirm that I have read, understood, and agree to this Lesson Agreement and the Cancellation & Make-Up Policy.
This electronic signature has the same legal effect as a handwritten signature.

                       SCHICH SWIM ACADEMY – CANCELLATION & MAKE-UP POLICY

1. Purpose

To ensure fairness, professionalism, and respect for both students and instructors, Schich Swim Academy maintains the following policy regarding cancellations, make-up lessons, and absences. These rules apply to all programs, including at-home lessons and classes held at partner facilities.

2. Billing Policy

All monthly automatic debit transactions will be charged on the 1st day of the month for the following month of lessons. Tuition reserves your child’s time slot and instructor, not the number of attended classes.

3. Cancellation & Notice Requirements

* Parents must provide at least 24 hours’ notice to cancel or reschedule a class.
* Cancellations made with less than 24 hours’ notice will result in the lesson being forfeited and will not qualify for a make-up.
* No-shows (failure to attend without prior notice) are not eligible for any form of make-up, credit, or refund.
* Habitual cancellations or rescheduling requests may result in the loss of preferred schedule or termination of enrollment.

4. Make-Up Lesson Allowance

* Students are entitled to 1 make-up lesson per month, provided the absence was communicated at least 24 hours in advance.
* Make-up lessons:

  * Must be scheduled after the missed class.
  * Are subject to instructor and time slot availability.
  * Cannot be rescheduled again once booked.
  * Must be used within 30 days of the missed class.
  * Do not roll over to future months.
  * Make-ups are a courtesy, not a right, and cannot be converted into credit or refunds.
  * If the instructor arrives and the lesson is cancelled on-site by the parent, the class is considered completed.

 5. Weather Policy (At-Home Lessons)

* Lessons will proceed in light rain, unless lightning or thunder is detected within a 10-mile radius.
* Only instructors are authorized to cancel lessons due to weather conditions.
* If conditions are deemed unsafe by the instructor, the lesson may be rescheduled without penalty.
* If the instructor arrives and the parent decides to cancel despite safe conditions, the class is forfeited.

6. Holidays & Closures

* The Academy follows a fixed calendar of holidays. These dates are already considered in the monthly tuition and therefore do not qualify for make-up or credit.
* If Schich Swim Academy must cancel a lesson for any reason (e.g., pool maintenance, instructor emergency), a make-up or credit will be arranged.

7. Medical Absences

* For verified medical absences, a doctor’s certificate must be submitted before the absence or within 48 hours in case of emergency.
* Only medical certificates containing the physician’s name, signature, and license number will be accepted.
* Extended medical absences may be evaluated individually by management.

8. Travel & Vacations

To maintain fairness and instructor scheduling stability:

* Vacations must be communicated at least 2 weeks in advance.
* For absences longer than 2 consecutive weeks:

* You may pause enrollment to avoid paying for unattended classes, provided notice is given by the 20th of the previous month.
* Spots and instructor availability cannot be guaranteed upon return.
* No make-ups will be issued for vacation-related absences.
* Short trips or long weekends fall under the standard cancellation and make-up rules.

9. Refunds & Credits

* No refunds, credits, or transfers are issued for missed lessons, cancellations, or early withdrawal from the program, including if the student discontinues after the first class or within the first few weeks of enrollment.

* Exceptions apply only in cases of documented medical conditions or program cancellation initiated by Schich Swim Academy.

* Monthly tuition reserves your child’s time slot and instructor, not the number of attended classes.

10. Enrollment Cancellation

* Written notice must be submitted by the 20th of the current month to cancel enrollment for the next month.
* Failure to provide timely notice results in full tuition being charged for the next month.
* All unused make-ups expire upon cancellation of enrollment.

11. Agreement

By enrolling in Schich Swim Academy, you acknowledge that you have read, understood, and agreed to this policy.
This ensures a structured, respectful, and professional learning environment for every student and instructor.
